Former President Donald Trump’s defence team questioned the legitimacy of his criminal case during a tense hearing before US District Court Judge Tanya Chutkan in Washington, DC. Trump faces four felony counts related to overturning the 2020 US presidential election, although he was not present at the hearing. Defence lawyer John Lauro cast doubt on the charges and the timing of the case, claiming the indictment may be illegitimate.
Lauro argued that a recent Supreme Court decision granting presumptive immunity to presidential actions should result in the case’s dismissal, leading to a sharp exchange with Judge Chutkan. She emphasized that the court was only concerned with the criminal counts at hand and not the timing of the 2024 election.
The hearing marked the first in nearly a year and addressed Trump’s claims of immunity and allegations of encouraging his supporters to interrupt the certification of the Electoral College votes on January 6, 2021. The prosecution, led by Special Counsel Jack Smith, issued an updated indictment focusing on Trump’s actions as a candidate in the 2020 election cycle.
Trump’s defence team resubmitted his plea of not guilty to the superseding indictment, with Lauro suggesting that the recent Supreme Court decision would nullify certain interactions. Chutkan remained firm, stating she would decide on the matter.
